COA reversed the trial court and held the contract at issue in this appeal is an implied contract which does not fall within the waiver of sovereign immunity set out in the Kentucky Model Procurement Act, Kentucky Revised Statute (“KRS”) 45A.245.

Vacated and remanded. Questions arose re personal jurisdiction and maintenance, income roles of parties had reversed, and assignment of debts.

Affirmed dismissal of negligence claim against adjoining landowner whose yew bushes grew through fence separating properties which killed claimant’s cows.

Defense verdict in med mal case affirmed on appeal. Multiple issues involved. Good read.

Affirmed defense verdict in med mal case. Failure to diagnose.
389. Haley v. Commonwealth of Kentucky
Affirmed denial of claim of ineffective assistance of counsel claim by criminal defendant in RCR 11.42 motion.
