396. Commonwealth of Kentucky Energy Cabinet v. Harmon
Statute of Limitations. Board of Claims. Savings Clause.
The Kentucky Board of Claims dismissed the Appellees’ tort claims against the Energy and Environment Cabinet, Department of Natural Resources (the Cabinet) as barred by the one-year limitation contained in KRS 244.110. The Pike Circuit Court reversed the Board’s decision, finding the Appellees’ claims were properly before the Board because of Kentucky’s “savings statute,” KRS 413.270, and remanded the case to the Board for appropriate proceedings. We reverse the circuit court and reinstate the Board’s order dismissing.

Family Law. Affirmed the trial court’s order incorporating the parties’ settlement agreement reached at mediation into the final dissolution decree over Paula’s objection.

Independent Contractor and Breach of Duty.
Affirmed SJ in favor of homeowner when roofer fell finding no breach of duty and independent contractor.

401. Estate of Tiffany Ann Paige v. Estate of Kyson Gage Pennington
It is uncontroverted that at the time of Tiffany’s death Kyson was still alive. Kyson died the following day at a hospital. Therefore, in accordance with McCallum, 379 S.W.2d 438, we conclude that the circuit court properly determined that Kyson’s estate was entitled to the insurance proceeds recovered for the wrongful death of Tiffany pursuant to KRS 411.130.
