Breathalyzer Testing. Statutory rights.
Commonwealth of Kentucky appeals from the Campbell Circuit Court’s order reversing and remanding the Campbell District Court’s order holding that William Morgan’s statutory rights under Kentucky Revised Statutes (KRS) 189A.105(4) were violated subsequent to his arrest for driving under the influence of alcohol (“DUI”). The circuit court held that the violation of Morgan’s statutory rights mandated suppressing the results of Morgan’s breathalyzer test.

742. MATTHEWS (MACK)  VS.  COMMONWEALTH OF KENTUCKY 
Criminal Law.
Matthews claims the trial court twice abused its discretion. First by denying his pretrial request to be tried separately from co-defendant Anthony Ball2 and then by denying a requested mistrial after Ball suggested police violated the law prompting another jury admonition from the bench. Having reviewed the record, briefs and law, we affirm.

In this post-dissolution appeal, Dennis E. Baker has sought review of the June 11, 2018, judgment of the Kenton Family Court ordering him to pay his former wife, Mary Patricia Baker (Patty), the sum of $6,519.12 as her share of his past retirement benefits. We affirm.

748. WILLIFORD (PENNY MARIE)  VS.  WILLIFORD (RUSSELL DRAUGHON
Domestic Violence Order, Hearing.
Appellant, Penny Williford, appeals the Simpson FamilyCourt’s August 1, 2018, domestic violence order entered against her at the urging of her husband, Appellee, Russell Williford. Penny claims she was not afforded a full evidentiary hearing and that evidence presented did not meet the preponderance of the evidence standard. After careful review, we affirm.

749. JEFFRIES (BILLY S.)  VS.  JUSTICE AND PUBLIC SAFETY CABINET,

Billy S. Jeffries has appealed from the order of the Franklin Circuit Court denying his motion for summary judgment challenging his need to register as a sex offender pursuant to Kentucky’s Sex Offender Registration Act (SORA), Kentucky Revised Statutes (KRS) 17.500 et. seq. Finding no error, we affirm.
