The Supreme Court of Kentucky will hear oral arguments on October 16 and 17, 2013 at the State Capital in Frankfort.
There are two tort, insurance and civil procedure cases set to be heard this week.
On Oct. 16 at 11:00 am: Nissan NA v. Messerly
Products Liability. Defective Design. Issues involve the propriety of summary judgment for the defense in litigation arising out of a fatal back-up accident in which a child was struck in 2004 by a 2002 SUV designed without a rearview camera or back-up sensor.
Oct. 17 at 9:00 am: Gaither vs. Justice & Public Safety Cabinet
Board of Claims. Immunity. Wrongful Death. Issues include whether state police are immune from a wrongful death claim based on their failure to protect a confidential informant.
