Highlights from this week’s decisions include

341.  Negligence. Qualified Official Immunity
Plummer vs. Lake
COA, Not Pub. 4/18/2014 from Garrard County

The Plummers argued that summary judgment was improper because the officers breached a duty of care both in failing to contain Cunningham and also in pursuing him. Further, the Plummers maintain that the officers violated various provisions of the Manual. And finally, that the officers were not entitled to qualified official immunity.

Court of appeals affirmed summary judgment dismissing claims against police officers, the city, and the police department holding the actions of the police officers were not negligent, and if they had been, would have been protected by qualified official immunity. Affirmed.
