C.R.G. v. Cabinet for Health and Family Services
2009-CA-000276 10/30/09 2009 WL 3487036
Opinion by Judge Thompson; Judges Stumbo and Wine concurred.

The Court affirmed an order of the family court terminating appellants’ parental rights to their minor children. The Court held that clear and convincing evidence existed to support the trial court’s finding that the children were abused and neglected and that termination of the mother’s and father’s parental rights was in the children’s best interest. Because the applicability of Anders v. California, 386 U.S. 738, 87 S.Ct. 1396, 18 L.E.2d 493 (1967), to termination of parental rights appeals was not brought to the attention of this Court by the parties and because the briefs were not accompanied by motions to withdraw, the Court declined to consider them as Anders briefs or to address whether Anders may be invoked in a termination of parental rights case.
