On discretionary review, CA reversed Circuit Court order dismissing juvenile’s appeal following finding of contempt. Here, the indigent juvenile was entitled to have his appeal reinstated due to his court appointed counsel’s failure to file a brief which constituted ineffective assistance. Both parties herein are in agreement that the Kentucky Supreme Court’s decision in Wine v. Commonwealth, 694 S.W.2d 689 (Ky. 1985), is controlling and entitles A.M. to have his appeal reinstated.
