    Appellant was convicted of three counts of complicity to second degree rape. Her  aughter gave birth to three children. The father of the children was appellant’s  oyfriend. Appellant allowed her boyfriend to marry her daughter. The Supreme Court has partially remanded his conviction based upon the marriage. Appellant now alleges that her conviction must also now be reversed.

    The issue in this case is whether the State of KY is pre-empted from taxing the gross receipts of providers of direct satellite broadcast and wireless cable service under the Supremacy Clause of the U.S. Constitution and whether section 602 of the Telecommunications Act of 1996 pre-empts KRS 160.614 as it applies to these providers.
